Main Objectives:

 

Under the supervision of the Director, Legal & Compliance, APAC, the main objectives for this role are:

 

  • Legal Support: Provide counsel on general legal issues within Korea, including identifying and analyzing legal matters, drafting legal memorandums, preparing legal documents, presenting legal recommendations, and managing litigation.

  • Compliance Management: Design, implement, maintain, and enforce compliance initiatives aligned with the company’s code of conduct and policies. This includes staying updated on industry developments and relevant laws such as the U.S. Foreign Corrupt Practices Act (FCPA), Korean Anti-Graft Act, and Korean Medical Devices Act. The role also involves acting as a subject matter expert on local compliance issues, particularly those related to fraud, abuse, advertising, promotion, and clinical activities.

 

Roles & Responsibilities:

Legal:

 

  • Strategy Development: Develop and execute legal strategies to align with Arthrex Korea’s business objectives.
  • Legal Counsel: Provide general legal guidance on various matters, including contracts, regulatory compliance, and risk mitigation.
  • Document Management: Draft, review, amend, and negotiate legal agreements related to Sales, Marketing, Medical Education, HR, Finance, QA/RA, and Operations.
  • Risk Analysis: Conduct thorough assessments of potential risks and legal implications.
  • External Counsel Collaboration: Work with external counsels on specialized legal areas and manage litigation as instructed by the Director of Legal & Compliance, APAC.
  • Intellectual Property: Support the Global IP team in protecting company IP and develop an IP protection strategy for Arthrex Korea.
  • Data Privacy: Collaborate with the Global Data Privacy team to develop the global privacy program in Arthrex Korea.
  • HR Support: Assist Human Resources with Employee Relations matters.
  • Investigation Management: Manage investigations by national, regional, and local authorities.

Compliance:

  • Policy Development: Develop, initiate, maintain, and revise compliance policies and procedures for the subsidiary and distribution network.
  • Training: Design, prepare, and deliver on-site compliance training for the subsidiary and distributor network, including the preparation and distribution of training materials.
  • Risk Management: Collaborate with the Third-Party Risk Management team to manage risks associated with distributors and other third parties.
  • Audit Support: Assist the Global Compliance Assurance team in conducting compliance audits of subsidiaries and distributors.
  • Guidance and Remediation: Provide instruction and guidance to distributors on their compliance programs and help remediate audit findings.
  • Program Management: Oversee the day-to-day operation of the compliance program, ensuring it prevents illegal, unethical, or improper conduct.
  • Violation Response: Respond to alleged violations of rules, regulations, policies, procedures, and the Code of Business Conduct by recommending investigative procedures and overseeing a system for handling such violations.
  • Performance Monitoring: Continuously monitor the compliance program’s performance and take steps to improve its effectiveness.
  • Leadership Engagement: Actively engage and contribute to Arthrex Korea’s Leadership Team, embodying the values and upholding the culture of Arthrex through your behavior

 

About You:

 

  • Legal Qualification: Passed the national Bar exam and admitted to practice law in the country.
  • Degree: Bachelor’s degree in law required.
  • Experience: Preferably 12 or more years of experience in legal, compliance, audit, and training roles.
  • Industry Experience: Experience in the medical device, pharmaceutical, or life sciences industry is preferred.
  • Expertise: Strong knowledge of local compliance regulations and industry codes.
  • Multi-national Experience: Compliance experience in a multi-national company is preferred
  • Language and communication skills: The candidate must have business fluency in both Korean and English, demonstrating superior written and verbal communication skills. They should be able to interact effectively at all organizational levels and collaborate well within a team. Additionally, they need to comprehend and apply language skills as required by the job, effectively communicate ideas and issues to team members, and write and record data and information according to procedures.
  • Organization & Analytical skills: The candidate must demonstrate strong organizational and analytical skills. They should be capable of defining problems, collecting data, establishing facts, and drawing valid conclusions. Additionally, they need the ability to interpret a wide range of technical instructions in mathematical or diagram form and handle both abstract and concrete variables.
